Draft — requires legal review before launch. The bracketed fields below must be completed with your registered entity details, and a qualified lawyer should review the whole document, particularly the data sourcing and liability sections.
1. Who we are
These Terms govern your use of the Gravitron Data API and website, operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS] (“we”, “us”). Contact: [SUPPORT EMAIL].
2. The service
We provide an API returning publicly visible product information from third-party marketplace websites. We are not affiliated with, endorsed by, or partnered with any marketplace whose data we return. All trademarks belong to their respective owners.
3. Accounts and API keys
You are responsible for keeping your API keys confidential and for all activity under your account. Notify us immediately of unauthorised use. You may revoke keys at any time from your dashboard.
4. Credits and payment
Access is sold as prepaid credits. One credit is consumed per lookup that returns a result, including a result stating that no product exists at the requested identifier. Credits are not consumed when a request fails due to a fault on our side; such credits are returned automatically.
Credits do not expire. Credits are non-transferable and have no cash value.
5. Refunds
Unused credits may be refunded within 14 days of purchase on request to [SUPPORT EMAIL]. Consumed credits are non-refundable.
6. Acceptable use
You may not: exceed your rate limit or attempt to circumvent it; resell or redistribute raw API responses as a competing data feed; use the service to infringe intellectual property rights; or use the service for any unlawful purpose.
7. Availability and accuracy
The service performs live retrieval from third-party websites. We do not guarantee uptime, completeness, or accuracy. Marketplace prices, sellers and stock change continuously, and a response reflects a point in time. Responses may be served from a cache of up to five minutes. You should not rely on this data as the sole basis for a financial decision.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising from your use of the service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect or consequential loss, including lost profits or business interruption.
9. Suspension and termination
We may suspend or terminate an account that breaches these Terms, and will refund unused credits where termination is not for a serious breach.
10. Changes
We may update these Terms. Material changes will be notified to your account email where we hold one.
11. Governing law
These Terms are governed by the laws of [JURISDICTION].
